ClubEntry - Terms of Use

Welcome to ClubEntry. These Terms of Use govern your access to and use of the ClubEntry web app and related services. ClubEntry is a link-based platform that lets hosts organise private events (parties and gatherings) and invite guests through personal invitation links, where they can vote on dates, sign up, bring friends, and pay for entry. By registering an account or using ClubEntry, you agree to these terms.

2. Description of Services

ClubEntry provides a platform that enables:

  • Event organisation: As a host, create events, manage a guest list, propose candidate dates for a vote, and add content (text, photos, videos) about your event.
  • Invitations: Generate personal invitation links and send them to your guests via WhatsApp or email.
  • Sign-up & friends: As a guest, view event details, sign up, and — where the host allows it — add your own friends as additional guests.
  • Entry payments: Where the host sets an entry price, pay for entry securely online (by card or TWINT). Hosts receive the collected amounts as payouts.
  • Admission: Receive personal tickets with a QR code and have them checked at the door by the host or a delegated person.

3. Registration and Account

3.1 Eligibility

You must be at least 16 years old to create an account. Users between 16 and 18 need the consent of a parent or legal guardian. An account is only required to organise your own events; as a guest you can take part through your invitation link without creating an account.

3.2 Account Information

You agree to provide accurate and complete information when registering and to keep your account information up to date. You are responsible for keeping your login credentials confidential. If you sign in with Google or Apple, the terms of the respective provider also apply.

3.3 One Account per Person

Each user may maintain only one account. Duplicate accounts may be suspended or deleted.

4. Host Responsibilities

When you organise an event, you agree to:

  • Only invite people and record their contact details (name, phone number, email) where you are entitled to do so and the individuals concerned agree.
  • Provide truthful information about your event, in particular the date, location, entry price, and included services.
  • Only upload content (text, photos, videos) that you have the necessary rights to and that does not infringe the rights of third parties.
  • Use collected entry fees properly and inform your guests promptly if the event is cancelled or changed.

5. Guest Responsibilities

When using ClubEntry as a guest, you agree to:

  • Use the platform only for its intended purpose and not share your personal invitation or ticket link without authorisation.
  • Only record a friend's details when adding them if that friend agrees.
  • Treat other guests, hosts, and staff with respect.
  • Not attempt to manipulate admission, the ticket system, or payments, or to gain unauthorised access to other accounts or systems.

6. Payments and Payouts

6.1 Entry Payments

Payments are processed through our payment provider Stripe and support credit and debit cards as well as TWINT. Full card details are handled directly by Stripe and are not stored on our servers. The entry price and included services are set by the respective host; the contractual relationship for the event is between you and the host.

6.2 Payouts to Hosts

Hosts can pay out collected entry fees, less the ClubEntry service fee, to their own account via Stripe Connect. A Stripe-verified account is required for payouts. ClubEntry is not a party to the event and assumes no responsibility for its execution.

6.3 Refunds and Cancellations

Refunds in the event of a cancellation or change are the responsibility of the respective host. Please arrange any refunds directly with the host.

7. Content and Intellectual Property

Content uploaded by hosts and guests remains their property; you grant ClubEntry the non-exclusive right to store this content and display it to the authorised participants of the event as part of the service. All ClubEntry trademarks, logos, and software are the property of ClubCourts GmbH or its licensors and may not be copied, modified, or distributed without prior written consent.

8. Limitation of Liability

8.1 Platform Availability

ClubEntry strives for a reliable service but does not guarantee uninterrupted or error-free operation. We may interrupt or change the service for maintenance or updates.

8.2 Events and Third Parties

ClubEntry only provides the technical platform. The organisation, execution, and safety of events are the sole responsibility of the respective hosts. ClubEntry is not responsible for the actions, policies, or services of hosts, payment providers, or other third parties.

8.3 Disclaimer

To the extent permitted by law, ClubEntry is not liable for indirect, incidental, or consequential damages arising from your use of the platform or your participation in an event.

9. Termination

9.1 By You

You can delete your account at any time. After deletion, your personal data is removed in accordance with our Privacy Policy, unless legal retention obligations apply.

9.2 By ClubEntry

We reserve the right to suspend or terminate accounts that violate these Terms of Use or engage in fraudulent or abusive behaviour.

10. Changes to the Terms

We may update these Terms of Use from time to time. Material changes will be communicated via the app or by email. Continued use of ClubEntry after such changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Use are governed by the laws of Switzerland. Disputes arising from these terms are subject to the exclusive jurisdiction of the courts at the registered office of ClubCourts GmbH in Baden, Switzerland.
